Terms of Use

1. Agreement

These Terms govern your access to and use of Pocket Chief!, the website, downloads, updates, and related services (the "Service"). The Service is provided by STARWISH LIMITED, NZBN 9429053547750, based in Wellington, Aotearoa New Zealand ("Starwish", "we", "us", or "our").

If you do not agree to these Terms, do not download, install, access, or use the Service.

2. Eligibility

You may use the Service only if you are at least 18 years old and have the legal capacity to enter into a binding agreement.

3. The Service

Pocket Chief! is a desktop AI companion that can provide chat, voice input, local activity review, todos, summaries, settings, and desktop companion features. Some features may be experimental, beta, unavailable, or changed over time.

4. Licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to install and use Pocket Chief! for your personal use. You do not acquire ownership of the app, brand, characters, artwork, interface, or other Starwish intellectual property.

5. AI features and limitations

The Service may produce AI-generated text, summaries, suggestions, classifications, reminders, reactions, or other outputs. AI outputs may be inaccurate, incomplete, inappropriate, misleading, or unsuitable for your situation.

You are responsible for reviewing AI outputs before relying on them. The Service does not provide medical, legal, financial, mental-health, safety, employment, or other professional advice.

6. Your responsibilities

You are responsible for:

• your device, operating-system permissions, local app data, backups, and API keys;
• the legality and accuracy of any information you enter or allow the app to process;
• complying with the terms of any AI model provider, app store, payment processor, or platform you use; and
• deciding whether Pocket Chief! is appropriate for your workflow and environment.

7. Acceptable use

You must not use the Service to break the law, infringe rights, invade privacy, bypass technical limits, abuse third-party services, distribute malware, harass others, or create security, operational, or reputational risk for Starwish or other users.

8. Privacy

Our handling of personal information is described in the Privacy Policy. By using the Service, you acknowledge that information may be processed as described there.

9. Third-party services

The Service may depend on third-party services, including AI providers, crash diagnostics, analytics, downloads, stores, payment processors, operating-system services, and hosting providers. We are not responsible for third-party services, terms, pricing, outages, model behavior, policy changes, or data handling outside our control.

10. Payments, Cookies, and refunds

If the Service is sold through Steam, another app store, or a payment platform, billing, taxes, cancellation, and refunds are handled under that platform's terms and policies unless we state otherwise.

Direct Cookies purchases are completed through Lemon Squeezy, which acts as merchant of record. Your Direct checkout and payment are also governed by the Lemon Squeezy Buyer Terms. Prices are shown in USD; applicable tax is calculated and shown at checkout. Your statement may identify Lemon Squeezy and the Pocket Chief store.

Purchases made through Steam are processed by Valve and are governed by the Steam Subscriber Agreement and the Steam Refund Policy, together with any applicable Steam checkout terms.

Pocket Chief Cloud may use Cookies as usage credits for Starwish-hosted AI features. Cookies are not money, stored value, a cash balance, securities, or a transferable asset. They have no cash value, cannot be withdrawn, transferred, redeemed for money, or refunded at a fixed exchange rate.

Direct Cookies are delivered to the signed-in Direct account that starts checkout. The receipt email entered at checkout does not change that account. Direct and Steam accounts, sessions, Cookies balances, orders, refunds, and entitlements are separate commercial assets. They do not merge or transfer between realms. Using the same local workspace on one operating-system account does not transfer or recover those assets.

Cloud usage consumes Cookies. Cookies already consumed by Cloud usage are not refundable or restorable, except where required by applicable law or the payment platform's mandatory policy. If a purchase is refunded, reversed, charged back, or reasonably determined to involve fraud or abuse, we may reverse the Cookies or entitlements associated with that transaction, place the relevant realm wallet into a negative balance, suspend Cloud access, or take other reasonable anti-abuse steps.

After a Direct account completes email one-time-password verification and Activity Activation, or a Steam account completes Steam ticket verification and Activity Activation, that account receives 3,000 Starter Cookies once in that commercial realm. These normal Starter Cookies are a guaranteed one-time allocation for a legitimately activated account. They are not subject to discretionary campaign quotas and will not be revoked merely because Starwish changes or ends a test, promotion, or admin programme.

Cookies separately identified as test, promotional, campaign, or admin-granted Cookies are distinct from the normal Starter Cookies above. Those separate grants may have stated eligibility, duration, usage, expiry, or revocation conditions, and may be changed or ended under those conditions, subject to applicable law. All such Cookies have no cash value.

11. Updates and availability

We may update, change, suspend, or discontinue any part of the Service. We do not guarantee that the Service will be uninterrupted, error-free, compatible with every device, or available forever.

12. Disclaimers and liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of accuracy, reliability, availability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Starwish will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, revenue, business, goodwill, data, opportunity, or anticipated savings.

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Governing law

These Terms are governed by New Zealand law. You and Starwish submit to the courts of New Zealand for disputes relating to the Service or these Terms.

14. Changes

We may update these Terms from time to time. If we make material changes, we may notify you through the app, on the website, or by updating the date above. Your continued use after updated Terms take effect means you accept the updated Terms.
